TERMS AND CONDITIONS

The following terms and conditions govern the services being provided to you (“Customer”) by Red Rover Rodent Removal (“Company”):

GENERAL TERMS AND CONDITIONS

1. Company shall provide elimination services (“Elimination”) to Customer at the address listed above.
Company shall choose the method of elimination best suited to address Customer’s needs. In addition,Elimination includes:

A .Removal of animal carcasses from attic, crawl space (if applicable) and areas around Customer address during the Elimination. If the animal carcass is in a wall, Customer may incur additional fees for removal and repair.

2. Customer may purchase Warranty Agreement (“Exclusion”). Exclusion includes sealing existing points of entry in the building, if Customer purchases Warranty Agreement, the below Warranty Agreement will apply.

B. If Customer does not purchase Warranty Agreement, Customer acknowledges that Company cannot provide services against re-entry and that elimination may need to be repeated.

Customer will be charged additional costs for any subsequent elimination, disinfection or re-entry prevention services.

3. Customer may purchase attic restoration services (“Restoration”). Restoration includes:

A. Removal and disposal of fouled insulation; and Replacement of insulation with the blown-in insulation (regardless of type removed), unless otherwise agreed between the parties and noted below.

4. Customer may purchase disinfection services (“Sanitation”). Sanitation includes:

A. Sanitizing attic using Sporicidin disinfectant; and more extensive clean-up than included in standard Elimination, plus Sporicidin disinfection, of additional locations in the building, as mutually agreed upon.

5. Customer shall respond to calls or messages from Company within 24 hours to facilitate provision of services.

6. Customer shall make place of service available for treatment and inspections as reasonably necessary.

7. Payment is due at time of service and/or at signing of contract.

8. In the event any obligation of this agreement must be enforced by Company, through litigation or otherwise, Company will be entitled to recover reasonable costs and expenses incurred in enforcing the obligation, including costs and reasonable attorneys’ fees.

9. IN NO EVENT WILL COMPANY BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES.

10. This is the entire agreement between Company and Customer and supersedes all prior and contemporaneous promises, representations or agreements, whether oral, implied or written.

11. Customer is to call office only if assistance is needed. Customer understands that they have hired The Company and not the technician and must not call technician directly.

12. All checks are to be made payable to Red Rover Rodent Removal. All forms of payment are to be made payable to Red Rover Rodent Removal.

13. Customer forfeits any Service Agreements and or additional service trips from company if credit card is charged-back. Even if the credit card company reverses in favor of the Company.

EXCLUSION Warranty Agreement:

For a period of (days) after completion of Exclusion services, Company provides a twelve month service agreement for re-entry at the building points sealed by Company. In the event of a re-entry at a different location, Customer shall be liable for a $199 service charge and any costs associated with future repairs. This Warranty Agreement applies only to Customer and is non-transferrable (unless approved by the office). This Warranty Agreement may be renewed for additional time
upon payment of the renewal fee listed below.

This Warranty Agreement does not apply to:

1. Crawl spaces where animals dig under the foundation. If this occurs, Customer acknowledges Company would need to employ other methods for exclusion at additional cost. If such additional exclusion methods have been purchased under this agreement, then this Twelve Month Service agreement shall apply; Points of re-entry (even if previously sealed by Company) resulting from damage to the building caused by acts of God, including but not limited to wind, rain, rising water or falling trees or limbs; Any work or services performed outside the scope of this agreement.

2. Alteration of the building, including but not limited to changing the structure of the roof or any other home modifications that may make the building vulnerable to re-entry.

3. Customer tampering or self-help, including Customer use of poisons, traps or any other method of elimination not provided by Company;

4. Poor sanitation;

5. Customer’s failure to make timely payments.

6. Customer entering into a side agreement with an employee of Red Rover Rodent Removal for the employee in his/her individual capacity to perform services that are offered by Red Rover Rodent Removal.

7. If customer is refunded any money, the contract will be void.

**CUSTOMER HAS 3 DAYS FROM DATE OF CONTRACTS TO CANCEL, IF WORK IS NOT PERFORMED AT THE TIME OF SIGNING. BY ALLOWING COMPANY TO START WORK BEFORE THE 3 DAY COOLING OFF PERIOD, CUSTOMER IS WAIVING THE (3) DAY COOLING PERIOD. BY SIGNING CUSTOMER AGREES TO TERMS OF CONTRACT AND PAYMENTS.
